Website Terms and Conditions

The B Collective Pty Ltd | Robyn Birkin | robynbirkin.com

Effective date: 10 October 2026. Version prepared: 9 October 2026.

These terms govern use of our website and the purchase and use of our business education, strategy, coaching, consulting and digital resources. They include our general artificial intelligence policy. Please read them before purchasing or participating. Your specific purchase information and, for Peace + Profit, the separate Terms of Participation also form part of your agreement.

1 About us and how to contact us

1.1 The website robynbirkin.com is operated by The B Collective Pty Ltd, an Australian company based in Perth, Western Australia, providing services under the Robyn Birkin brand. In these terms, “Company”, “we”, “us” and “our” mean The B Collective Pty Ltd. Robyn Birkin and our team act for the Company when delivering its services; your contract is with the Company unless expressly stated otherwise.

1.2 Our contact email is hello@robynbirkin.com. Our ABN is 48 633 264 909 and our business address for legal notices is PO Box 2, WOODVALE WA 6026, AUSTRALIA. Please use the contact email for purchase enquiries, access issues, complaints and requests about these terms.

1.3 “You” means the person using the website or the purchaser identified in the accepted order. If a business purchases a place for a participant, the purchaser is responsible for payment and the named participant must also accept the participation, confidentiality, intellectual property and conduct obligations. A participant is not personally liable for a business purchaser’s fees unless they separately agree to that liability.

2 Scope and definitions

2.1 “Website” includes our website pages, public articles, podcast material, registration pages, sales pages and checkout pages that link to these terms. “Services” includes business strategy, coaching, consulting, the Peace + Profit Mastermind, private engagements, workshops and other services actually offered by us. “Resources” includes paid or free videos, audio, recordings, templates, workbooks, playbooks, prompts and other digital materials we supply.

2.2 “Purchase Information” means the specific description, price, currency, payment schedule, dates, duration, inclusions, access period, advertised bonuses and any special guarantee or cancellation arrangement provided before you purchase and recorded in the accepted order or written engagement. A material representation made to you before purchase is not removed merely because it is omitted from a confirmation email.

2.3 “AI” means artificial intelligence and automated systems, including generative text, image, audio and video tools, chatbots, custom assistants, transcription, summarisation and automated analysis. “Confidential Information” includes non-public business strategies, financial information, client information, account details, unpublished content and information reasonably understood to be confidential. Personal information is information about an identified or reasonably identifiable individual.

2.4 These terms do not promise that every type of service, resource or feature described here is available or included in a purchase. Your Purchase Information identifies what we have agreed to provide.

3 Acceptance and the order of documents

3.1 By using the website, you agree to the provisions relevant to website use. Before placing a paid order, you must be given a reasonable opportunity to read these terms and any applicable service terms. A purchase agreement is formed when we accept your order in writing or provide the purchased access following successful payment, whichever occurs first. An application or enquiry alone does not guarantee admission.

3.2 For a purchase, the agreement consists of the Purchase Information, any specifically agreed written engagement, applicable service terms and these terms. If provisions conflict, mandatory law prevails first, then a specifically negotiated written variation, the specific Purchase Information, applicable service terms and these general terms, in that order. A general disclaimer does not override a specific promised inclusion, guarantee or representation. Peace + Profit participation is additionally governed by its separate Terms of Participation.

3.3 Our Privacy Policy explains how personal information is handled. It is a separate privacy notice, not permission to use information for undisclosed purposes and not a means of reducing the contractual protections in this agreement. An additional policy becomes a contractual obligation only if it is clearly identified and made available before acceptance, or subsequently agreed where necessary.

3.4 We will provide confirmation of your purchase and the applicable terms in a form you can retain. Please retain your order, offer and payment schedule. Changes to a website page do not retrospectively change an existing purchase.

4 Eligibility and authority

4.1 Paid services are intended for adults aged 18 or over. You must have legal capacity to contract and, if acting for a business, authority to bind that business. You must provide accurate contact, billing and application information and notify us of material changes relevant to delivery.

4.2 Services are intended for business education and development. This intended use does not prevent you from being a consumer under applicable law or remove protections available to small businesses. We may decline an application before acceptance where the service is unsuitable, unavailable or outside its stated eligibility criteria. If we decline an order for which payment has been taken, we will refund it promptly.

5 Nature of our services

5.1 We provide business education, strategy, coaching and consulting with reasonable care and skill. Specific deliverables and the balance of group, individual, live and asynchronous support depend on your Purchase Information. General website material is information, rather than individual advice tailored to your circumstances.

5.2 Unless expressly included, we do not undertake implementation, business management, bookkeeping, accountancy, tax advice, legal advice, regulated financial advice, investment advice, recruitment, public relations, publicity procurement, medical treatment, psychological treatment or therapy. Discussions about mindset, confidence or decision-making are business coaching and do not replace qualified health care.

5.3 We do not become your employee, agent, partner, joint venturer or business manager. We cannot bind your business, make purchases for it, manage its accounts or enter contracts on its behalf without a separate express authority. Access does not include introductions to our network, procurement of clients, publicity or employment unless specifically agreed.

5.4 You remain responsible for deciding what to implement, managing your business, supervising your team and obtaining appropriate professional advice. We remain responsible for our own promised services and legal obligations. Your responsibility does not excuse a failure by us to deliver with required care and skill.

6 Results and earnings statements

6.1 We do not guarantee a particular revenue, profit margin, number of clients, audience size, conversion rate, return on investment, hours of work, lifestyle outcome or timeframe unless an express written guarantee is part of your Purchase Information. Marketing objectives and examples are not themselves guaranteed outcomes, but we must still make accurate, supportable representations.

6.2 Results depend on factors including your offer, experience, audience, market demand, pricing, resources, implementation and market conditions. Testimonials and case studies describe individual experiences and may not represent typical outcomes. Revenue figures are not necessarily profit or personal income; historical performance and forecasts do not assure future performance.

6.3 These qualifications do not contradict an express representation we make, remove liability for misleading conduct, exclude consumer guarantees or permit us to provide a service materially different from what was sold. If a specific guarantee is offered, its conditions must be disclosed before purchase and it operates in addition to mandatory rights.

7 Fees currency taxes and additional costs

7.1 You must pay the price, in the currency and on the schedule disclosed before purchase. We will state the total commitment and any mandatory charges. Australian prices are inclusive of GST where GST applies unless a clearly identified lawful business quotation states otherwise. The GST treatment of overseas supplies depends on applicable law and is not determined solely by your location.

7.2 Any difference between a payment-plan total and an upfront price must be disclosed before acceptance. We cannot increase the agreed price during a fixed paid term without your express agreement. Discounts and promotional prices are governed by the conditions disclosed with the offer and are not retrospectively applied to earlier purchases unless we agree.

7.3 Your bank or payment provider may impose currency conversion or international transaction fees that are outside our control. We do not impose additional card surcharges unless disclosed before payment and permitted by law. Advertising spend, software subscriptions, contractors, travel and other implementation expenses are your responsibility unless expressly included. We will not incur additional charges on your behalf without approval.

8 Payment plans and payment authority

8.1 A payment plan spreads payment for the agreed purchase. It does not create a cancellable monthly subscription unless the offer expressly says so. The total fee, instalment amounts, due dates and any minimum commitment must be clear before purchase.

8.2 By selecting an automatic payment plan and providing a payment method, you authorise our payment provider to process the specified instalments and reasonable retries of failed scheduled payments. This authority does not permit charges for new offers, unagreed renewal terms or other amounts not authorised under the agreement.

8.3 You must keep your payment method current and contact us promptly about payment difficulties. Cancelling a card or payment authority does not by itself cancel a valid underlying payment obligation. Any refund, cancellation, credit or termination right in this agreement or under law takes priority over further collection.

8.4 If payment fails, we will notify you and ordinarily allow at least seven calendar days to resolve it or agree an arrangement before suspending paid access. We may act sooner in a reasonably suspected fraud or security incident. Suspension will be proportionate and lifted promptly once the issue is resolved. An extension or other remedy may be appropriate if suspension was caused by our error.

8.5 We do not charge contractual late-payment interest under these general terms. We may seek reasonable, actually incurred and legally recoverable external recovery costs for an undisputed overdue debt after notice, but not arbitrary penalties or costs caused by our error. We will not treat a genuinely disputed amount as conclusively payable simply because we say it is. Court-awarded interest or costs remain subject to law.

8.6 We will not automatically accelerate all future instalments because one payment fails. Any claim for remaining fees or damages must have a lawful basis, account for services not supplied and reasonable mitigation, and avoid double recovery. You may exercise lawful payment-provider dispute or chargeback rights; we may provide accurate evidence in response. A genuine complaint or chargeback is not by itself misconduct.

9 Delivery access and availability

9.1 Access dates, live support periods and resource access periods are those in your Purchase Information. Unless expressly promised, a purchase does not include indefinite access, future programmes, future paid upgrades or ongoing coaching after the agreed term. Free resources may be changed or withdrawn prospectively, subject to any specific commitment already made.

9.2 Paid digital access is ordinarily delivered using the email address supplied at purchase. Contact us if access is not received within the stated delivery period. We will investigate delivery and access problems and provide an appropriate remedy where we have not supplied what was agreed.

9.3 You are responsible for a suitable device, internet connection and any ordinary free account requirements disclosed before purchase. A requirement for additional paid software must be disclosed before purchase if needed to receive the promised service. We will make reasonable efforts to accommodate notified accessibility needs, taking account of the nature of the service and applicable law.

9.4 We use third-party platforms for payment, meetings, community and content delivery. Their independent account and platform terms may apply. We remain responsible for our agreed service and cannot shift all responsibility for its delivery to a platform provider. We will use reasonable efforts to restore access or provide an alternative if a platform failure materially affects delivery.

9.5 We may undertake reasonable maintenance or migrate platforms while preserving the substantial benefit of the purchase. We will give reasonable notice of planned material interruptions and instructions for migration. Material loss of an agreed inclusion or access period is dealt with under clause 24, rather than being treated as an unlimited right to change the service.

10 Live sessions bookings and communication

10.1 The published service schedule and Purchase Information specify the available live sessions, channels and individual appointments. Group calls do not automatically provide private consulting. A group call may use hot seats, discussion or teaching; not every participant is guaranteed an individual hot seat at every call unless expressly promised.

10.2 Times will identify a timezone. Perth operates on Australian Western Standard Time, UTC+8. You are responsible for checking local conversion and daylight saving changes. We will communicate schedule changes reasonably promptly and provide a replacement or appropriate alternative where a promised session is cancelled by us.

10.3 One-to-one booking, cancellation and rescheduling rules must be provided before purchase or appointment confirmation. In the absence of an agreed rule, please give reasonable notice; we will not impose an undisclosed cancellation fee. Missed group sessions do not automatically create an entitlement to a private replacement, but this does not affect remedies for our failure to supply a promised service.

10.4 Unless otherwise specified, support is provided on business days in Perth, excluding Western Australian public holidays and any breaks disclosed before purchase. Asynchronous support is not real-time, emergency or unlimited one-to-one availability. We will respond within a reasonable time and honour any express response commitment.

11 Refunds cancellation and mandatory rights

11.1 Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable Australian Consumer Law consumer guarantees and mandatory overseas protections. Those rights apply even if you purchase for business use where the law provides that protection.

11.2 Where Australian Consumer Law consumer guarantees apply, goods and services must meet the applicable guarantees. Services must be provided with due care and skill and, where applicable, be fit for a disclosed purpose or result and supplied within a reasonable time if no time is agreed. Depending on the failure, remedies can include rectification, replacement, cancellation, refund, price reduction and compensation. A major service failure may entitle you to cancel or seek compensation for reduced value; a remediable failure must be addressed within a reasonable time. We will provide the remedy required in your circumstances.

11.3 Subject to those rights and any express offer-specific guarantee, we do not offer refunds merely because you change your mind, choose not to access materials, do not attend, change business direction or fail to achieve a desired result despite services being supplied as agreed. Immediate digital delivery does not remove statutory remedies. Payment-plan obligations remain subject to any lawful cancellation, refund or adjustment.

11.4 Contact hello@robynbirkin.com with your purchase details, the issue and your requested outcome. We may reasonably assess the issue and request supporting information, but will not impose an arbitrary time limit on statutory claims, require original packaging for digital products or make legal rights depend on completing the entire programme.

11.5 We will process an agreed or legally required refund promptly and within any mandatory timeframe, ordinarily using the original payment method unless otherwise agreed. We will not deduct an administration fee from a statutory refund unless law permits it, or replace a cash remedy with credit without agreement.

11.6 Any statutory cooling-off right or expressly advertised exit or satisfaction guarantee applies according to its lawful conditions. No additional voluntary guarantee is created by these general terms. If overseas consumer cancellation rules require an express request for early service delivery or separate consent for immediate digital supply, we will obtain the required request and acknowledgement; accepting these general terms alone is not treated as that separate consent.

12 Accounts and authorised users

12.1 Account access is for the named participant or licensed users identified in the purchase. Keep credentials secure and notify us promptly of suspected unauthorised access. You must not share a login, sell a place or permit a contractor, client or colleague to participate using your account without our written permission.

12.2 You are responsible for account activity you authorise or negligently enable, but not automatically liable for every unauthorised act regardless of fault. We will reasonably assist with security issues and investigate suspected misuse before imposing a final sanction where practicable.

12.3 Permitted internal use of a completed worksheet or output is different from account sharing. A limited licence to involve your team in implementation does not give them access to our portal, community, member recordings or other participants’ information.

13 Permitted use of the website

13.1 You may browse the website and use public information for lawful personal or business purposes. You must not interfere with website security, introduce malicious code, impersonate another person, evade access controls, harvest personal information, send unsolicited messages or use the website to infringe another person’s rights.

13.2 Automated collection must respect applicable law, access restrictions and our intellectual property. You must not systematically extract or republish protected content, access paid material without permission or use our content to build or train a competing content system. This clause does not prohibit lawful statutory uses or ordinary search indexing of unrestricted public pages.

13.3 We may restrict access reasonably necessary to address security, fraud, unlawful conduct or material misuse. Paid access restrictions are also subject to the notice, proportionality and remedy provisions in clause 25.

14 Community standards

14.1 Where community access is included, participate respectfully. Do not harass, discriminate against, threaten or abuse others; disclose another person’s confidential information; post unlawful material; impersonate others; spam channels; or repeatedly disrupt the service. Constructive disagreement, candid questions and lawful complaints are permitted.

14.2 Do not use our private community, member directory or calls to send unsolicited sales pitches, mass direct messages, recruit members into another paid service or collect contacts for external marketing without permission. This is a restriction on misuse of the community, not a restriction on members’ freedom to buy other services, compete lawfully or maintain independent professional relationships.

14.3 We may moderate content reasonably to preserve safety, confidentiality and the purpose of the service. We will not remove or punish an honest review merely because it is unfavourable. Any additional operational guidelines must be reasonable, consistent with the purchase and these terms, and cannot introduce material new obligations without agreement.

15 Confidentiality

15.1 Both you and the Company must protect Confidential Information received through a private engagement or community. Use it only for participation, delivery or another expressly authorised purpose. Do not disclose, reproduce or upload it externally without permission, including to an AI service, shared document, recording tool or public forum.

15.2 We may give access to team members and service providers who reasonably need it for delivery and who are subject to appropriate confidentiality and security arrangements. Information shared in a group setting will be accessible to the participating members and any notified authorised delivery personnel. Do not submit another person’s confidential or personal information without an appropriate lawful basis and permission where required.

15.3 Confidentiality does not cover information already lawfully public, independently developed without use of confidential material, already lawfully known to the recipient, or lawfully received from an unrestricted third-party source. Disclosure is permitted to professional advisers under confidentiality duties, where legally required, or to make a protected report or seek a lawful remedy. Where lawful and appropriate, give notice of compelled disclosure and disclose only what is necessary.

15.4 Our communities are not legally privileged spaces. Although members are bound by confidentiality rules, we cannot guarantee that every participant will comply. We will take reasonable steps to address reported breaches. Do not share passwords, payment credentials or unnecessary sensitive information.

15.5 Confidentiality continues after participation ends for as long as the information remains confidential. Trade secrets remain protected while they retain that character. Privacy obligations continue for as long as relevant information is held and as required by applicable law.

16 Intellectual property and your licence

16.1 We or our licensors own our website and Resource content, including its protected text, recordings, graphics, worksheets, templates, programme structures and other original expression. Trade marks and brand names remain the property of their respective owners. A purchase gives a licence, not ownership of our underlying intellectual property.

16.2 Unless a more specific licence is supplied, you receive a non-exclusive, non-transferable licence to access the purchased Resources during the agreed access period and use them for your own learning and the operation of the enrolled business. You may complete and adapt resources intended to be edited, implement general strategies in your business and use your own resulting marketing copy, plans and business documents commercially.

16.3 You may share your own completed business plan or implementation output with team members and professional advisers where reasonably needed to run your business, provided this does not give them reusable access to our proprietary resource library or reveal another participant’s information. They must protect any embedded confidential material. A separately licensed resource may impose additional disclosed restrictions.

16.4 You must not resell, sublicense, publish, circulate or commercially exploit our training, templates, recordings or protected resource library; remove attribution notices from underlying resources; or substantially reproduce them within another course, coaching programme, client portal, book, membership or paid service without permission. You must not use them to train, fine-tune or populate an AI system except as expressly permitted under clause 19.

16.5 Copyright does not give us ownership of every general idea, fact, business principle or skill you learn. You may apply your own knowledge, independently create your own materials and continue your lawful business. These terms protect our actual intellectual property and confidential material and do not create an undisclosed non-compete restriction.

16.6 When paid access ends, portal and community access ends as agreed. Unless the resource licence says otherwise, you may retain lawfully downloaded editable resources and your completed outputs for continued use in the same business, subject to the ongoing restrictions on sharing, resale, confidentiality and AI use. This does not entitle you to future updates, replacement downloads or live support.

17 White label or client facing resources

17.1 A resource can be used as white label material only if we expressly designate it that way and your purchase includes the relevant licence. No white label library is promised by these general terms. The supplied licence identifies permitted adaptation, client distribution, business use, duration and any limits.

17.2 Without a more specific written licence, an expressly designated white label resource may be adapted and delivered as a finished resource to clients of your own business within your existing service. You may not resell the source library as a standalone resource pack, grant onward resale or sublicensing rights, or distribute our unrelated training, recordings or member content.

17.3 A white label permission does not authorise AI model training, publication of source materials in a custom assistant or disclosure of another person’s information. Any express AI permission or broader distribution rights must be separately stated. Third-party fonts, images, software or content remain subject to their own licences.

18 Your submissions feedback and publicity

18.1 You retain ownership of your original submissions and pre-existing business material. You give us a limited, non-exclusive permission to access, store, copy and use submitted material to deliver the purchased service, give feedback, maintain records, administer the programme and handle relevant disputes. This is not a general licence to publish your confidential material or train AI on it.

18.2 You must have the right to provide material you submit. Please anonymise client and staff information and provide only what is necessary. If an audit concerns a third party’s protected work, ensure that the proposed review is permitted by licence or law. We will also handle submissions consistently with our confidentiality and privacy commitments.

18.3 We will obtain separate permission before publishing an identifiable testimonial, client story, revenue result, image, voice, private message, screenshot or recording for marketing. You may refuse without losing access to paid services. Permission will identify the approved content and intended use, and may be withdrawn for future use, subject to reasonable removal time and lawful retention of past records. We will not fabricate, materially alter or use AI to invent an endorsement.

18.4 Voluntary product feedback may be used to improve our services without paying a royalty, but this does not transfer ownership of your underlying work or permit disclosure of confidential details. We will not present your feedback as a public endorsement without permission.

19 Artificial intelligence policy

19.1 This clause applies to Company and participant AI use relating to our website, Services and Resources. It covers both inputs and outputs and applies whether an AI feature is standalone, built into a platform or operated through an external assistant.

19.2 We may use AI to assist with drafting general educational or marketing content, formatting, research support, administration and analysis of appropriately de-identified information. AI-assisted material that we supply remains subject to our obligations to provide the agreed service with reasonable care and skill. We will apply proportionate human review and verify material claims before relying on them.

19.3 We will not replace promised human coaching or consulting with an automated system without your express agreement. An optional AI feature does not create unlimited human review of every output. A customer-facing AI assistant, if offered, will be identified as automated and given an appropriate description of its limitations.

19.4 We will not input identifiable personal information, participant Confidential Information, private coaching communications, submitted audits or call recordings into public or consumer generative AI tools. Where AI processing of that material is proposed through a suitably controlled provider, we will first assess necessity, security, data flows, provider access, retention and model-training terms, and give an appropriate notice identifying the tool or provider, purpose, information processed, who can access it, overseas handling and available alternatives. We will obtain separate express consent for identifiable recordings, transcription and other uses requiring consent; other processing must have an appropriate lawful basis and comply with the notices given.

19.5 For approved AI processing of identifiable or confidential service material, we will use contractual and account controls that prohibit its use to train the provider’s general-purpose models, limit access and support appropriate retention and deletion. We will not proceed if those controls cannot reasonably be established. We will minimise information supplied and use de-identification where practicable; merely removing a name may not adequately anonymise a distinctive business story.

19.6 We will not use your personal information, confidential submissions, voice or image to train or fine-tune a model, create a reusable knowledge base for unrelated users or generate an avatar or synthetic likeness without a separate, specific opt-in agreement. Accepting these terms is not that permission. Your refusal does not remove the service originally promised to you.

19.7 You must not upload our paid Resources, proprietary frameworks as expressed in our materials, portal content, recordings, transcripts, member discussions or another person’s confidential material to an AI tool without express written permission. This includes ingestion into a custom GPT, chatbot, agent, searchable knowledge base or retrieval system, even where it is labelled private or says it does not train on uploads. Private settings alone do not grant a licence.

19.8 You may use your own business information, original ideas, completed outputs that do not reproduce restricted source material, and a prompt or extract that we expressly mark as approved for AI use. Permission is limited to the disclosed purpose and does not authorise upload of the rest of the resource, onward distribution or training a reusable model. You must remove third-party personal and confidential information unless you have all necessary permissions and safeguards.

19.9 Do not use AI to reconstruct or redistribute our proprietary library, create substitute copies of our training, impersonate us or another member, fabricate results or endorsements, or circumvent licence restrictions. You may use AI to help implement lawful, independently developed business work. AI use does not turn another person’s protected content into your own work or guarantee that an output is non-infringing.

19.10 Do not connect your own AI note-taker, meeting bot or recording assistant to our calls without prior written approval and consent from affected people. We may remove unauthorised bots. Approved access is limited to the agreed session, processing and retention conditions and does not override the recording rules in clause 20.

19.11 AI may produce inaccurate, biased, incomplete, outdated or fabricated material. Check factual claims, calculations, legal and regulatory statements, intellectual property, confidentiality and suitability before using outputs. Obtain qualified advice where appropriate. We do not promise exclusive copyright ownership or uniqueness in wholly machine-generated content; third-party rights and provider terms may apply.

19.12 A third-party AI subscription is not included unless stated. Where you independently choose an external tool, you contract with that provider and are responsible for its settings and your lawful use. Where we select a tool to deliver a promised service, we remain responsible for our selection and the relevant contractual and legal obligations. A disclaimer about AI limitations does not excuse our breach, negligence or unlawful disclosure.

19.13 Report suspected AI misuse or disclosure to hello@robynbirkin.com promptly. Preserve relevant evidence, stop unauthorised processing, and cooperate with proportionate containment and deletion steps. We will investigate, take reasonable protective action and make any notifications required by law. If you object to a proposed optional identifiable AI use, contact us before it starts; we will offer a reasonable non-AI alternative for the agreed service and will not treat your objection as misconduct.

20 Recordings transcripts and meeting privacy

20.1 We may record a session only after giving advance notice of the purpose, intended audience, storage and access arrangements and obtaining any required consent. Recordings and identifiable transcripts will not be used for public marketing without separate permission. A routine group replay, if provided, is restricted to the authorised participants identified in the notice.

20.2 You can ask for a confidential matter to be handled off-record or through another appropriate channel. Where you do not consent to recording, we will discuss a reasonable alternative before the session. Turning off your camera may not prevent your name, voice, chat or screen content from being recorded.

20.3 You must not record, screenshot, transcribe, download or redistribute another participant’s contribution without permission, except where we expressly authorise a download for restricted programme use. AI transcription requires the additional safeguards in clause 19. A recording licence does not allow reuse in your business or another programme.

20.4 We will provide appropriate retention information in the relevant recording notice or Privacy Policy and will not retain identifiable recordings indefinitely by default. Requesting deletion is subject to applicable rights, legal recordkeeping and proportionate needs such as resolving a dispute; we will explain any lawful refusal. Do not assume every call is recorded or that a replay exists unless it is an agreed inclusion.

21 Privacy communications and cookies

21.1 We handle personal information in accordance with the published Privacy Policy and applicable law. That notice should describe collection purposes, payment and delivery providers, international processing, retention, rights, complaints and contact details. We will use reasonable security measures, but do not promise that internet transmission is risk-free.

21.2 Participation may involve sharing information with authorised members and providers in Australia and overseas. Where a transfer requires particular notices, consent or safeguards, we will implement them. Agreeing to these terms is not an unrestricted waiver of privacy rights or blanket consent to every overseas disclosure.

21.3 We may send operational messages needed to administer your purchase. Marketing messages will follow applicable consent and unsubscribe requirements. Unsubscribing from promotional email does not cancel your purchase or prevent necessary service notices. Cookie, analytics and advertising practices are governed by the relevant privacy or cookie notice; any required preference or consent mechanism must be provided separately.

22 External services referrals and links

22.1 Links and references to external products are provided for convenience or education. Unless expressly stated, we are not affiliated with, sponsored by or endorsed by the referenced platform. We will disclose material commercial relationships or affiliate benefits where required and will not describe paid recommendations as independent.

22.2 If you separately purchase from an external supplier, its contract governs that purchase. We do not control that supplier’s service or future prices. This does not remove responsibility for representations we make or for a supplier we engage to perform our own contractual obligations.

22.3 We are not responsible for independent member-to-member commercial arrangements unless we separately agree to participate. Obtain appropriate advice and carry out your own checks before contracting with another member or a recommended provider.

23 Website accuracy and interruptions

23.1 We take reasonable care with website content but general information may become outdated. We may correct genuine errors. If a material price or description error affects an unaccepted order, we will explain it and allow you to accept the corrected offer or receive a refund of any payment. We cannot simply rewrite an accepted contract because it later becomes inconvenient.

23.2 We do not promise uninterrupted website availability. We will take reasonable steps to address problems affecting paid delivery. A public website interruption does not remove consumer rights or our duty to supply a purchased service. Save your own business files and do not rely on our portal as your sole permanent archive.

24 Changes to services and these terms

24.1 We may update these terms for future website use and future purchases by publishing a dated version. Existing purchases remain governed by the version accepted at purchase unless a lawful variation is agreed. Continued attendance, silence or continued instalment payment is not automatically consent to a material change.

24.2 We may make reasonable operational changes to delivery platforms, session arrangements and material presentation that do not materially reduce agreed value, access or inclusions. We will give reasonable notice where the change affects participation. We will not use this provision to remove promised support, increase a fixed fee or shorten a paid term.

24.3 If a material adverse change becomes necessary, we will explain it and seek agreement. If you do not accept, you may end the affected service without a cancellation penalty and receive a fair refund of prepaid undelivered services and release from corresponding future payments. Additional remedies required by law remain available. A purportedly equivalent substitute is not compulsory where law gives you a right to reject it.

25 Suspension and termination

25.1 We may suspend affected access where reasonably necessary to address non-payment, suspected fraud, security threats, unlawful activity, serious confidentiality or intellectual property misuse, or material disruption. Our response must be proportionate to the issue and its impact on others.

25.2 Except where immediate protective action is reasonably necessary, we will explain the issue in writing and give a reasonable opportunity, ordinarily at least seven calendar days, to remedy a remediable material breach. Immediate protective action will be followed by an explanation and a reasonable review opportunity as soon as practicable.

25.3 We may terminate for a serious irremediable breach, a material breach not remedied after appropriate notice, or repeated material breaches after warnings. You may terminate if we commit a material breach that is irremediable or not remedied within a reasonable notified period, or where you have another contractual or statutory right to terminate.

25.4 If we terminate without your material breach, or you validly terminate because of our breach or a material adverse change, prepaid undelivered services will be fairly refunded and corresponding future instalments cancelled, without restricting additional rights. On termination for your breach, amounts already earned may remain payable, but we will not automatically forfeit every prepayment and demand every future instalment. Any retention or further claim must reflect a lawful entitlement, actual loss, mitigation and services not supplied. No punitive termination fee applies.

25.5 On termination, account and live participation rights end, subject to any agreed remedy and continued licence to retained resources. Confidentiality, accrued lawful payment rights, intellectual property restrictions, privacy obligations and dispute provisions continue where relevant. Termination does not extinguish a complaint or statutory claim.

26 Events outside reasonable control

26.1 A party is not responsible for delay caused by an event genuinely beyond its reasonable control to the extent it could not reasonably prevent or overcome it. Examples may include natural disasters, government restrictions, widespread telecommunications failure and serious unexpected illness preventing agreed personal delivery. Ordinary lack of funds, poor sales or avoidable understaffing are not automatically such events.

26.2 The affected party must notify the other reasonably promptly, minimise the impact and resume performance as soon as practicable. We may propose rescheduling, equivalent delivery or an access extension, but will not require you to accept a material adverse change without the remedies in clause 24.

26.3 If material paid delivery remains unavailable for more than 30 consecutive days, either party may end the affected portion by written notice unless a different reasonable solution is agreed. Prepaid undelivered services will be fairly refunded and corresponding future payments cancelled. A right to a quicker remedy under mandatory law is not delayed by this period. Fees for services already properly supplied remain subject to the agreement and law.

27 Responsibility and liability

27.1 Each party is responsible for loss caused by its own breach of contract, negligence or unlawful conduct, subject to applicable law. Neither party excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence where exclusion is unlawful, or a right or remedy that cannot be excluded. We do not exclude all liability simply because information is educational or AI-assisted.

27.2 A party is not liable for loss to the extent caused by the other party’s own breach, negligence or unlawful conduct. Both parties must take reasonable steps to mitigate loss. You are responsible for independent business decisions, but not for loss caused by our own actionable failure merely because you implemented our guidance.

27.3 Subject to clauses 27.1 and 27.4, neither party is liable for losses that were not reasonably foreseeable when the agreement was made. A loss is not excluded just because it is described as consequential, indirect, loss of revenue or loss of profit; foreseeable loss recoverable under mandatory law remains recoverable.

27.4 No monetary liability cap or restriction to resupply applies under these general terms. Any separately proposed limit must be clearly disclosed, lawful, reasonable in context and specifically agreed; it cannot override mandatory guarantees or remedies. This agreement does not require you to release all claims or treat discontinuing use as your only remedy.

28 Third party claims

28.1 A party may seek recovery of reasonable third-party claim costs directly caused by the other party’s unlawful conduct, negligent conduct or material breach, including knowing infringement or unauthorised disclosure, only to the extent law permits and fault is attributable to that party. This is not an unlimited indemnity for use of, or inability to use, the service.

28.2 The claiming party must give prompt notice, provide reasonable information, mitigate loss and allow reasonable participation in the response. Costs must be properly incurred and recoverable; losses caused by the claiming party’s own breach or negligence are excluded to that extent. Neither party may agree to an admission of fault or non-monetary obligation binding the other without consent, not unreasonably withheld. There must be no double recovery.

29 Reviews complaints and truthful statements

29.1 You may give honest reviews, discuss your own experience, make lawful complaints, obtain advice and report concerns to regulators, courts or payment providers. We do not require a promise never to criticise us. We also reserve the right to respond accurately and protect legitimate confidentiality and intellectual property interests.

29.2 Neither party should knowingly make false statements about the other, unlawfully harass others or disclose unrelated confidential information under the guise of a review. This clause does not prevent protected disclosures, lawful evidence, truthful reporting or legally permitted criticism.

30 Complaints and disputes

30.1 Contact hello@robynbirkin.com with a description of the dispute and proposed resolution. We will ordinarily acknowledge a written complaint within five Perth business days and aim to provide a substantive response within 20 Perth business days. If investigation takes longer, we will explain the delay and provide a reasonable update. These targets do not extend a statutory deadline or prevent urgent action.

30.2 Where practicable, both parties will attempt in good faith to resolve the matter directly. They may agree to independent mediation with a jointly selected mediator and agreed cost allocation. Mediation is voluntary and does not create a mandatory expense or barrier to exercising legal rights.

30.3 You may contact an appropriate consumer authority, regulator, ombudsman, payment provider, tribunal or court at any time. Nothing requires you to waive claims, stop a limitation period expiring, keep unlawful conduct secret or complete our internal process before seeking relief. Either party may seek urgent protective or interim orders.

31 Governing law and overseas customers

31.1 Subject to mandatory law, this agreement is governed by the law of Western Australia and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of courts competent to hear the dispute in Western Australia. This does not prevent a claim in a court or tribunal with jurisdiction under mandatory local law.

31.2 Overseas purchasers retain applicable mandatory local protections, including any enforceable consumer, privacy, cancellation or digital-content rights. We do not represent that a Perth governing-law clause overrides them or that describing the purchase as business coaching removes them. If a country-specific addendum is required for a sale, it must be supplied before acceptance.

31.3 You must comply with laws applicable to your own business and implementation. We remain responsible for our own cross-border selling, tax and privacy obligations. No clause transfers those obligations wholesale to you.

32 Notices and assignment

32.1 Send contractual notices to hello@robynbirkin.com and identify your purchase. We will send notices to the current email address you supply and may use the programme channel for ordinary scheduling messages. A notice is treated as received when it reaches the recipient’s email system and is capable of being retrieved, subject to contrary evidence. Statutory service rules take priority.

32.2 Neither party may transfer the agreement in a way that materially disadvantages the other without consent, not unreasonably withheld. We may use appropriately qualified subcontractors while remaining responsible for delivery and confidentiality, but may not remove a promised personal service or transfer personal information contrary to law. A business transfer must preserve existing obligations and any required notice, consent or remedy.

33 General provisions

33.1 If a provision is invalid or unenforceable, it will be severed to the minimum lawful extent if the remainder can operate. This does not authorise enforcement of an unfair term or allow a court to be asked to rewrite it into an acceptable term automatically.

33.2 A delay in enforcing a right is not itself a waiver. A waiver must be clear and does not automatically waive a later breach. Contractual rights operate in addition to statutory rights unless lawful agreement says otherwise.

33.3 The documents identified in clause 3 record the purchase agreement. Nothing here excludes liability for pre-contract misleading statements, removes a material promise or prevents reliance on evidence of what was offered. Written variations may be made by email where clearly agreed by authorised representatives.

33.4 Headings aid navigation. “Including” means including without limitation. A reference to law includes applicable amendments. References to days mean calendar days unless expressly described as business days. Any mandatory legal rule overrides an inconsistent provision.

34 Contact and clarification

If you have questions about these terms, accessibility, AI permissions, refunds, a proposed purchase or an existing service, contact hello@robynbirkin.com. Please seek clarification before purchasing if an inclusion or condition is unclear. Your right to ask questions or exercise a legal remedy continues after purchase.
